You might have already put these items on the Works Council agenda for discussion, or perhaps you are already actively working on them together or alone. Then this is simply a friendly reminder. But perhaps you were not familiar with everything just yet, in which case this is a 'convenient checklist'.

mandatory changes and legislative changes: what about the role of the Works Council?
The list of changes for 2024 also includes a few legislative changes. We (very) frequently encounter Bestuurders who state that a legislative change is mandatory, and that (because of that!) the Works Council "no longer has anything to say about it". Unfortunately for Bestuurders: that is not true!
Anything provided in the Dutch (Works Councils Act) or other laws and regulations and arrangements always continues to apply. Even if laws are amended, the Bestuurder's obligation to seek advice and consent continues to exist. Often, what is important is how laws and regulations are translated into the organisation.
A good example is the new Dutch Pensions Act, the Wet toekomst pensioenen (Dutch Future Pensions Act). All employers are obliged to adjust their organisation's pension scheme to the new Act. However, the Works Council still has a right of consent (Section 27 (1)(a) of the Dutch Works Councils Act - Dutch) with respect to any adjustment of or change to the pension scheme in your organisation, i.e. also if this is 'required' on account of a legislative change.
The Works Council has a role in respect of nearly all of these changes and adjustments, which continues to exist.
